- Non-Consummation and Impotency
If you haven't consimmated your relationship within one year of marriage due to wilful refusal by your spouse or if your spouse is impotent, then you can seek a divorce.
- Unsound Mind
Your spouse was of unsound mind and is still so and this fact was not known to you before marriage.
- Desertion
This applies in cases where your spouse has deserted you for three years or more.
- Imprisonment
Your spouse has been sentenced to imprisonment for seven years or more and has already spent a year in jail.
- Conversion
Your spouse ceases to be a Parsi by conversion of religion.
- Bigamy
If your spouse is involved in bigamy, rape or any other unnatural offence.
- Venereal Diseases
If you or your spouse suffers from any venereal disease.
- Prostitution
Your spouse compels you into prostitution.
- Absence of Spouse
In case your spouse goes missing for even continuous years or more and his whereabouts are not known, you are entitiled to file for a divorce.
- Cruelty
Your spouse abuses you and your children, either physically or mentally.
Mutual Consent
If both you and your spouse decide to break off the marriage, then you can file a petition for divorce through mutual consent.
Under this ground you will have to back up the petition with;
- The proof of your marriage.
- Mutual acceptance of the fact that you cannot live with each other.
- Consent from both parties to dissolve the marriage.
