AIDS Laws in India
- Article 14 and 15 of the Indian Constitution gives every Indian the right to Equality and protects them against discrimination.
But other than that India has no law to prevent discrimination against people living with HIV/AIDS.
The only Bill which can prevent discrimination - the HIV/AIDS bill 2005 - is currently with the Law Ministry. And its likely to be tabled in the Monsoon Session of Parliament.
The Bill looks at preventing discrimination against HIV/AIDS infected people in the workplace, in educational institutions and in healthcare.
But the Bill does not make discrimination against HIV/AIDS infected people, a punishable offence.
Instead it suggests 'softer' punishments like community service.
Demystifying the Disease
- HIV is Human Immunodeficiency Virus.
AIDS is Acquired Immune Deficiency Syndrome.
Not all HIV+ individuals have AIDS.
HIV can remain in latent state for many years.
AIDS doesn't spread through casual contact (hugging, handshake, 'dry' kissing, sharing toilet, exposure to coughing and sneezing of AIDS patient)
AIDS virus is extremely 'unstable' in an open environment.
Mosquito bite does not spread AIDS.
Tattooing does not increase the risk of AIDS.
Sexual intercourse with a virgin does not cure AIDS.
